Booking Terms and Conditions

Introduction
In these Terms and Conditions:
- “Hotels” means any of the hotels or properties owned, operated or franchised by Minor Hotels which includes, without limitation, any of our Oaks, Avani, NH, or Anantara properties in Australia or New Zealand.
- “Minor Hotels”, “Oaks”, “operator”, “we”, “our”, “us”, collectively means Minor Hotels Australasia Limited ACN 113 972 366 / ABN 70 113 972 366 (or any of its subsidiary, or related entities). Minor Hotels’ corporate headquarters is PO Box 12020, George Street, QLD 4003, Australia.
- “User” means any user of our Websites.
- “Websites” means any websites and apps to take, manage, and accept bookings of our Hotels, which includes, without limitation, oakshotels.com, avanihotels.com, and any social media pages or sites.
- “You” means any individual, entity, or guest making a booking and/or staying at our Hotels (directly or indirectly, through other means) or any individual, entity, or guest as a User of our Websites..
- Any reference to a form of payment by card includes credit cards and debit cards.
These Terms and Conditions apply to any booking of our Hotels or guest’s stay at our Hotels. By making a booking at our Hotels, by whatever means, You agree to be bound by these Terms and Conditions.
Each Hotel may also have additional accommodation and booking terms and conditions, which will be notified to you upon making a booking or upon check-in.
Where bookings are made on other platforms (other than our Websites) or through a third-party operator (such as a third-party operator/website), additional terms and conditions (as notified by that other platform or third-party operator/website) may apply.
If you request a booking of one of our Hotels and we accept that booking, it is implied that you accept (unconditionally):
- our Privacy Policy;
- if booking on one of our Websites – the Legal Notice (such as the Minor Hotels Legal Notice) relating to website use displayed on that website and our Website Terms and Conditions;
- these Booking Terms and Conditions (Terms and Conditions); and
- any other additional terms, notices, regulations, and/or instructions provided to you.
To the extent of any inconsistency between these Terms and Conditions and any specific term (including, without limitation, any terms specific to the region in which a relevant Hotel is located as set out in these conditions), the specific term, will prevail to the extent of that inconsistency.
We recommend you carefully read these Terms and Conditions (as well as any additional policies and conditions) before requesting or completing your booking at our Hotels as these conditions incorporate the basis on which bookings for our Hotels are accepted.
Furthermore, we recommend you do so every time you make a booking at our Hotels, as we reserve the right to change, modify, add, or delete, part or all of these Terms and Conditions, at any time.
Reservation Confirmation
A booking at one of our Hotels becomes valid and binding on the relevant operator of the Hotel only after the reservation has been accepted by the operator of the Hotel, you have received an email confirmation, and we received a payment or pre-payment (if required). That is why for your reservation it will be necessary to provide the requested information, which will be treated in accordance with our Privacy Policy.
Secured Payments
If you make a booking on one of our Websites and you make a payment to us, it will be processed by a payment gateway system that collects your card information and encrypts it for later processing. In any case, the payment gateways that are used for this purpose, will be secure and comply with the necessary legal and technical requirements in order to make your payment secure.
Guarantee Policy
A valid credit card is required at time of booking, and a valid physical credit card must be presented at time of check-in to the Hotel. Digital cards are not currently accepted. Additionally, we will not accept a credit card that is not in your name (i.e. the credit card name and booking must be in the same name). This is required to make a valid booking and check-in. We may refuse to check you into the Hotel if you do not provide this.
Foreign Currency
Conversion into foreign currency displayed on our Websites is given as an indication and is not the exact amount that will be charged to you for your booking. Only the amount confirmed in the reservation confirmation is the amount you will be charged.
Pricing Errors
We reserve the right to cancel reservations with manifest and evident errors in price or service at any point in time (at no cost to us). In such cases, we will offer you the option to make a new booking at the correct price and/or with the correct information.
Identification
Upon arrival at the Hotel, you must provide valid and current passport or government issued photographic identification for security purposes (or such other identification we require).
Your booking must be under the name of the person checking in to the Hotel.
In addition, any person checking in must also provide a physical credit card that matches the name in the photographic identification. Digital cards are not currently accepted.
Please refer to our Privacy Policy for how we collect and retain personal information.
Children
Children must be accompanied by at least one Adult (such as their parents, authorised teachers, or other duly authorised guardian) at all times whilst in the Hotel.
Children sleep free on existing bedding in the Hotel room/apartment, within the maximum allowed guests per room (as notified by us).
If a roll away/cot/sofa bed is required, charges will apply. Those charges are available from our reception desk at the Hotel.
A room/apartment cannot be booked in our Hotel without an Adult also staying with that Child.
Please note only Adults may make bookings at our Hotels.
For the purposes of this condition:
- “Child” or “Children” means a person or persons aged between 2 years and 17 years; and
- “Adult” means a person aged 18 years or over. All ages will be determined/verified at check-in (and will be the age of the person at check-in).
Cancellation and Changes to Bookings
Generally speaking:
- Changes and cancellations are permitted up until 2:00pm (as determined by the time where the Hotel is located) 1 day prior to your reservation date; and
- Changes or cancellations after this time (being within 24 hours of the 2:00pm check-in time or as noted above) will be charged in full. No shows will also be charged in full.
However, different accommodation rates, group/meeting bookings and Hotels may be subject to their own terms for changes and cancellations. This includes the following:
- For bookings that are “Best Flexible Rates” (or similar):
- Changes and cancellations are permitted up until 2:00pm (as determined by the time where the Hotel is located) 1 day prior to your reservation date; and
- Changes or cancellations after this time (being within 24 hours of 2:00pm check-in time as noted above) will be charged in full. No shows will also be charged in full.
- For bookings that are “Non-Refundable Rates” (or similar):
- To offer you this special price, you may not make any changes or cancellations. If you do not use your booking, you will be charged in full.
- For bookings that are “Long Stay 7+ Day Rates” (or similar):
- Changes and cancellations are permitted up until 2:00pm (as determined by the time where the Hotel is located) 1 day prior to your reservation date; and
- Changes or cancellations after this time (within 24 hours of 2:00pm check-in time as noted above) will be charged a 7-night cancellation fee. No shows will also be charged a 7-night cancellation fee.
- For bookings that are “Group Bookings” and “Meeting Bookings”:
- Cancellation requests will be treated on a case-by-case basis and will be subject to any contract or booking terms and conditions that apply to those bookings (if applicable).
- For bookings made at Oaks Lake Crackenback Resort (except as listed below):
- Changes and cancellations are permitted up until 2:00pm (as determined by the time where the Hotel is located) 7 days prior to your reservation date;
- Changes or cancellations after this time (within 7 days of 2:00pm check-in time as noted above) will be charged in full. No shows will also be charged in full; and
- Please email the Hotel directly to request our policy on changes and cancellations for bookings made before 13 August 2025 at Oaks Lake Crackenback Resort.
- For bookings that are “Advance Purchase Rates” (or similar bookings made at Oaks Lake Crackenback Resort):
- 50% payment is charged at time of your booking, with the balance due 60 days prior to arrival;
- Changes and cancellations are permitted up until 2:00pm (as determined by the time where the Hotel is located) 60 days prior to your reservation date;
- Changes or cancellations after this time (within 60 days of 2:00pm check-in time as noted above) will be charged in full. No shows will also be charged in full; and
- Please email the Hotel directly to request our policy on changes and cancellations for bookings made before 13 August 2025 at Oaks Lake Crackenback Resort.
- For all other Hotel bookings:
- Changes and cancellations are considered on a case-by-case basis (excluding where a booking was made with an authorised third party, in which case the additional terms and conditions of that booking will apply).
All other promotions will be as per their specific terms and conditions offered at the time of promotion.
We reserve the right to:
- cancel or modify your reservation where it appears that you (or someone making the booking) have engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error; and/or
- cancel or modify your reservation if they do not adhere to these Terms and Conditions (or other notified terms and conditions).
Fees for late check-outs will be the fees notified by the Hotel to you and in all circumstances will not exceed one night’s accommodation for your booking (subject to any other charges we may be entitled to charge you under these Terms and Conditions, such as cancellation fees).
Deposit
We may charge a pre-authorisation deposit to your credit card to cover:
- any incidental charges incurred by you;
- any damage you cause whilst staying at the Hotel; and
- any costs we incur in cleaning your room as a result of you leaving the room in an unreasonable condition at check-out.
Where a pre-authorisation deposit is to be taken, it will be taken at check-in and will be the amount communicated to you at that time.
The timing of the release of the funds is controlled by your bank. This typically takes up to 10 business days.
The pre-authorisation will affect your available funds balance or spending limit. For more information on this practice, we suggest contacting your bank for more information. Once a pre-authorisation has been made, we cannot release, remove or lower the authorised amount, until we process the final account on departure.
For any bookings made on oakshotels.com that require pre-payment made via the website, the transaction will be listed on your bank statement under the Minor Hotels’ head office location i.e. Minor Hotels Brisbane. Payments will not be listed under the Hotel’s location.
Please note cash is not an acceptable form of bond or deposit and will not be accepted.
Insurance
We strongly recommend you purchase Comprehensive Travel Insurance that covers your accommodation costs (and any damage to the Hotel you cause). We suggest that the policy includes, but is not limited to, the following coverage – loss of payment through cancellation, loss or damage to personal baggage, damage to property, loss of money and medical expenses.
Privacy
When you make a booking with us and when you stay with us, we collect certain personal information from you. By making a booking you consent to your personal information being collected by us and for us to use that information in accordance with the terms of our Privacy Policy. Access to, and correction or deletion of, the personal information we collect from you is dealt with in accordance with our Privacy Policy.
The party collecting your personal information will be listed on your registration card and will be the operating entity that operates the particular Hotel.
Your Use of the Hotel
You agree to use the Hotel room/apartment in a reasonable manner in accordance with these Terms and Conditions during your stay and return the room/apartment to us at the end of your stay in the similar condition it was on check-in. You acknowledge that use of the Hotel and its facilities is at your own risk.
You further agree to be liable to us for the cost to repair any damage you (or any of your guests) cause to the Hotel during your stay and any excessive cleaning required as a result of you leaving the room (or any part of the Hotel) in an excessively unclean state. The cost of such charges will be the costs we incur, and cleaning will be charged at commercial rates.
You authorise us to take any charges or costs from your credit card pre-authorisation (provided by you on check-in).
You also agree to comply with all signage at the Hotel (regarding your use of the Hotel) and any “House Rules” or similar rules and policies notified by us to you. For your safety and our other guests’ comfort, you also agree to comply with all reasonable directions of our staff at the Hotel, including in particular directions by our staff. In these Terms and Conditions, “House Rules” includes all of the rules we notify you that you must comply with when occupying the property as well as any applicable by-laws of the strata or body corporate scheme (if applicable). Our reception staff will have a copy of these rules for inspection upon check-in.
You agree that in those hotels where we notify you that there is a safe in your room or in the reception area, you must follow the policies of use and responsibility established in that hotel or country (including following the directions on the safe for the use of the safe).
You agree not to take photographs or film any part of the Hotel for commercial purposes without our prior written consent. We remind you that is forbidden to take photographs or film other Hotel guests or staff without their express consent.
During your stay, we reserve the right to evict you from the Hotel if you (or any of your guests) are not complying with these Terms and Conditions, any House Rules, any directions from staff or we otherwise form the reasonable belief that your (or your guests) continued presence at the Hotel will cause us (or others) to suffer loss or damage, put the safety of you, us or others at risk, or will bring the Hotel into disrepute. If we evict you, the cost of the accommodation at the Hotel for all of your stay is non-refundable and you will be required to settle your account in full prior to departure (as well as any other costs we are entitled to receive or recover from you under these Terms and Conditions or as a part of your booking).
Facilities (availability and maintenance)
From time to time, features and facilities of our Hotels are unavailable or taken offline for repairs, maintenance or as directed by the owners of the Hotels.
If any feature/facility is essential for you in choosing a particular Hotel, we recommend contacting the Hotel prior to booking to ensure that feature or facility is available at the time of your booking.
We will not be liable for omissions or errors, whether temporary or permanent, of the description of our Hotel’s facilities and services. Photos shown on our website (or any other location) are indicative only and may not specifically represent the exact room/apartment allocated to you.
Destination images featured on the/our website may not represent the views offered from our locations.
Accommodation facilities listed may not apply to all room types.
Relocation
In the event of a situation whereby we cannot provide accommodation as previously confirmed for whatever reason, Hotel staff will undertake to relocate you to a comparable alternate Hotel with no additional cost to you. The alternatives offered are at our absolute discretion.
Should you wish to choose a Hotel, or a room/apartment in a Hotel of a higher standard other than offered under this condition, you will be required to pay any additional price difference.
Should you not wish to accept the relocation, a full refund & booking cancellation will be granted.
Internet Access
We offer Wi-Fi internet access at select properties allowing customers to connect to the Internet up to 3 mobile devices per booking.
Our Wi-Fi is operated by a third party, and we therefore take no liability or responsibility (whilst you are using our Internet network or Wi-Fi) for:
- the non-availability of the Internet network,
- the speed of the Internet network;
- the availability or access to websites;
- external intrusion;
- computer viruses you may obtain whilst using the network; and/or
- non-authorised online transactions or losses to you whilst using the network.
Part of your accommodation booking charges may include a charge payable to us for the use of the internet. The amount of the charge will be set out in your guest registration card provided upon arrival (if any). If you do not wish to use this service, please discuss this with our reception staff upon arrival.
Force Majeure
The Hotel shall not be liable for any failure or delay in the performance of its obligations under this agreement if such failure or delay is caused by circumstances beyond its reasonable control, including, but not limited to, acts of God, natural disasters, fire, flood, earthquake, war, terrorism, civil disturbance, government action, labor disputes, pandemics, epidemics, or any other event that could not have been foreseen or prevented with reasonable diligence (“Force Majeure Event”).
In the event of a Force Majeure Event, the Hotel shall communicate with you as soon as possible, explaining the situation, the expected impact, and will try to mitigate the impact of the Force Majeure Event on your reservation or stay. If the Hotel is unable to perform its obligations due to a Force Majeure Event, the Hotel may cancel your reservation and will offer you an alternative date or a refund, without further liability.
Updates
We may revise these Terms and Conditions from time to time by updating this web page.
The revised terms will take effect when they are posted and will only apply to bookings made after the updates.
Severability
If any part of these Terms and Conditions should be determined unenforceable, invalid, or illegal, it is to be read down so as to be enforceable, valid, and legal. If this is not possible, the term, condition or where possible, the offending part is to be severed without affecting the enforceability, validity, or legality of the remaining terms and conditions (or parts of those conditions) which will continue in full force and effect.
No Waiver
Failure to insist upon or enforce strict performance of any of these terms and conditions shall not constitute a waiver thereof.
Governing Law and Jurisdiction
These Terms and Conditions (and any booking/stay) are governed by, construed, and enforced in accordance with the laws applicable to the jurisdiction the Hotel is located in (i.e. Australia or New Zealand).
In respect of any dispute over these Terms and Conditions, booking, or stay at our Hotels, you agree to irrevocably and unconditionally submit to the exclusive jurisdiction (and will file any dispute in) the following courts:
- for bookings at Hotels located in Australia, in the courts located in Queensland, Australia and any courts which have jurisdiction to hear appeals from any of those courts; and
- for bookings at Hotels located in New Zealand, in the courts located in Auckland, New Zealand and any courts which have jurisdiction to hear appeals from any of those courts.
Accordingly, you waive any right to object to any proceedings being brought in those courts.
The foregoing shall not apply to the extent that applicable law in your country of residence requires application of another law and/or jurisdiction and this cannot be excluded by contract.
Check-in and Check-out
- Unless we agree or notify you otherwise, check-in is at 2:00pm and check-out is at 10:00am (with the exception of Oaks Auckland Hotel as the check-in time is 3:00pm).
- The property reserves the right to charge you an early departure fee in the event you depart earlier than the original departure date.
- Late check-outs may be available upon request. You must contact Reception to check availability and confirm any late check-out. Additional fees may be applied by us.
- A late check-out fee may apply if the property is not vacated prior to the set check-out time of the Hotel (see below).
Fees for early departures and late check-outs will be the fees notified by the Hotel to you and in all circumstances will not exceed one night’s accommodation for your booking (subject to any other charges we may be entitled to charge you under these terms and conditions, such as cancellation fees).
No Party Policy
We have a strict no party policy when you are staying with us. In the event that you (or any of your guests) are identified as having a party (in our view), we reserve the right to immediately request all occupants of the Hotel room/apartment up to, and including, the guest who has registered for the room/apartment, to vacate the room/apartment and the Hotel as a whole.
Pet Policy
At this stage, no pets or animals are allowed to accompany you to our Hotels, other than properly registered and licensed (where required) assistance animals.
Fees (Credit Card Surcharge)
All credit / debit card payments made to us via an onsite payment system:
- will incur a 1.5% non-refundable card service fee in Australia; and
- will incur a non-refundable card service fee between 2.0% and 3.35% (2.0% - VISA, MASTERCARD, 2.0% AMEX, or 3.35% DINERS) in New Zealand.
Notwithstanding the above, from 1 October 2026, there will no longer be any card service fees charged on VISA, MASTERCARD, or EFTPOS payments in Australia.
Australian Consumer Law
Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits us to limit our liability, then our liability is limited to:
- In the case of services, supplying the services again or payment of the cost of having the services supplied again; and
- In the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
Nothing contained in these Terms and Conditions is intended to exclude, restrict or modify any warranty or guarantee provided under the Australian Consumer Law (which cannot be excluded, restricted or modified).

Limitation of Liability
Notwithstanding anything contained in these Terms and Conditions to the contrary and to the extent permitted by law and any warranty or guarantee provided under the Australian Consumer Law (which cannot be excluded, restricted or modified), we shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arising out of the performance or non-performance of obligations under these terms and conditions or as otherwise implied by law.
Additional Terms and Conditions – Promotions and Campaigns
Dynamic Pricing Model
We offer the following promotional rates according to a dynamic pricing structure. The discount applied to the Best Available Rate varies in response to room availability and is determined at the time of making your booking.
Stay and Save / Stay 2 Save 10% / Stay 3 Save 15%
A promotional discount ranging from 5% to 15% may be applied.
- Minimum stay: 2 or 3 nights (which differs between our Hotels which are Participating Properties); and
- Maximum stay: 6 nights.

Stay Longer and Save 7+ Nights / Long Stay Rate
A promotional discount ranging from 15% to 20% may be applied.
- Minimum stay: 7 nights

Early Bird
A promotional discount ranging from 10% to 20% may be applied.
- Minimum stay: 2 or 3 nights (which differs between our Hotels which are Participating Properties);
- Maximum stay: 6 nights; and
- Bookings must be made at least 14 days prior to arrival.

1. Minor DISCOVERY Campaign Terms and Conditions
The Minor DISCOVERY Loyalty Programme is subject to its own terms and conditions, please refer to our Website at https://www.minorhotels.com/en/loyalty/terms-and-conditions (Minor DISCOVERY Loyalty Programme General Terms & Conditions).
Minor DISCOVERY benefits are subject to change without notice, and can include:
- Early check-in from 12pm and late check-out up to 11am, subject to availability;
- A best price guarantee on public advertised rates;
- A 10% discount off the best flexible rate (this may not be valid on promotional offers or deals where a greater benefit may apply); and
- Kids under 5 eat free at all Oaks restaurants where a buffet meal applies. Kids aged 5-12 will receive a 50% discount of the buffet price. Where a buffet menu does not apply, a special children’s menu will be provided upon request.
In addition to the benefits outlined above, members may also have the ability to earn DISCOVERY Dollars (D$) on eligible spend and redeem D$ on eligible transactions at select properties. Where available, the earning and redemption of those D$ is subject to the Minor DISCOVERY Loyalty Programme General Terms & Conditions.
In the event of an inconsistency between these terms and conditions and the Minor DISCOVERY Loyalty Programme General Terms & Conditions, the Minor DISCOVERY Loyalty Programme General Terms & Conditions prevail to the extent of the inconsistency.
Please note benefits are only valid/applicable when bookings are made directly with Oaks Hotels, Resorts & Suites and you are a Minor DISCOVERY member. Please ensure you sign up to Minor DISCOVERY Loyalty Programme.
2. Oaks Giving Tree Terms and Conditions
Donations made by you will be collected as part of the Fundraising Initiative Oaks Giving Tree and will be made in support of the Charity Habitat for Humanity Australia (HFHA).
The partnership between Minor Hotels and HFHA will be limited to Minor Hotels acting as an Approved Fundraiser having authority to fundraise on behalf of HFHA and will not be liable for the distribution of funds collected nor will it be responsible for the issue of tax receipts for donations of AUD $2.00 or more.
Such obligations will be the responsibility of HFHA as the beneficiary charity in compliance with any Charitable Fundraising Act and/or Regulation as applicable. More details on this Fundraising Initiative can be found at the HFHA website.

If you include an optional add on (as listed below) to your stay, the following additional terms apply:
3. Oaks Grocery Hamper Terms and Conditions
If you request that we provide you with a Grocery Hamper (before or during your stay with us):
- All of Coles terms and conditions (see: https://www.coles.com.au/important-information/customer-agreement) apply to the supply of the Grocery Hamper in addition to these terms and conditions. If you select a Grocery Hamper as part of your booking, these terms and conditions are incorporated into your accommodation booking terms and conditions.
- To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Grocery Hamper and your consumption or use of it, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and similar warranties.
- Cancellation: You may not cancel or amend your Grocery Hamper order once made. If you cancel your accommodation booking with us, we will endeavour to cancel the order of your hamper and if we are able to do so, your hamper order will be cancelled with your accommodation booking. Late cancellations of bookings may not result in the cancellation of your Grocery Hamper (due to the timing of when we order the hampers).
- You may not purchase more than one of each of the Grocery Hamper types (per accommodation booking).
- Please ensure dietary and allergy needs are considered before adding a hamper to your booking. We recommend that you read the label on the products you purchase or contact the manufacturer of the product for further details.
- Payment for your Grocery Hamper will be made with payment of the balance of the booking at the Property (upon check-in).
- Collection: Your Grocery Hamper will be packed and ready for you to collect from the reception of the Property at the time of check-in unless Coles has not delivered the hamper on time, in which case we will deliver it to your room as soon as reasonably possible.
- Amendments: You are unable to provide any alterations or amendments to the contents of each Grocery Hamper as each hamper is standardised. However, we (or Coles) may, at our (or Coles) election provide substitute products of equal or higher value (where necessary) in line with the Coles standard online grocery terms and conditions See: https://www.coles.com.au/important-information/customer-agreement .
- Any complaints on hampers should be directed to the Hotel Manager.
4. Food and Beverage Credit
- Food and Beverage Credits are non-refundable once full payment has been made at check-in.
- If you wish to remove the Food and Beverage Credit from your booking without incurring any charges, please ensure this is done prior to check-in. Please contact us directly with your booking reference and the name on your booking to make any changes.
- The Food and Beverage Credit must be used in a single transaction at the property.
- If your total spend is less than the value of the Food and Beverage Credit, the remaining balance will be forfeited, and no refunds will be provided. Unused credits cannot be carried over to future bookings or transferred to other stays. All credits must be utilised during your stay and cannot be applied across multiple bookings.
5. Experiences
- Experiences added to your booking will only be charged at check-in and will be finalised once full payment has been made.
