Terms and Conditions of Entry for Oaks Hotels, Resorts & Suites “Win Your Perfect Recovery Stay” Competition (Promotion).

Please read the terms and conditions carefully. By entering this Promotion, you have confirmed you have read, understood and agree to be bound by these terms and conditions.

1. These terms and condition of entry, including, without limitation, information on how to participate and the prize or promotion details (Terms), apply to the Promotion, and entry into the Promotion is deemed acceptance of these Terms by an entrant.
2. The promoter is Minor Hotels Australasia Limited ACN 113 972 366 / ABN 70 113 972 366 of Level 26, 266 George Street, Brisbane, Queensland 4000 (Promoter).
3. The Promotion will be open from 00:00 AEST on 25 May 2026 until 23:59 AEST on 2 August 2026 (Promotion Period). Any entries received after the Promotion Period will be deemed invalid entries and will not be considered.
4. Information on how to enter and/or participate in this Promotion and any prize information not listed in these Terms is deemed to be incorporated into (and form part of) these Terms.
5. To the extent of any inconsistency between these Terms and anything else that refers to this Promotion, these Terms will prevail.
6. Entry in this Promotion is only open to natural persons who are resident in Australia and aged 18 years and over, expressly excluding:
   1. management, employees, directors and contractors of the Promoter or its related bodies corporate as well as the participating and other agencies, firms or companies associated with the Promotion (including suppliers of prizes if applicable);
   2. a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 6(a) of these Terms;
   3. persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
   4. persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter.

   The persons referred to in paragraph 6(a) of these Terms includes natural and non-natural relations, The Promoter is responsible for determining a person’s eligibility for the Promotion. The Promoter’s decision on whether a person is eligible to enter or participate in this Promotion is final and may be determined in the Promotor’s absolute discretion.

7. Entries in the Promotion are personal to each entrant and are incapable of being assigned, novated, or transferred to any other person.
8. All entrants agree that if they win the prize, they will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the Internet. Photographs will be allowed only at the discretion of the Promoter.
9. The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the Promotion result or any other decisions the Promoter makes in connection with the Promotion.
10. Personal information used and/or collected for the purpose of this Promotion will be processed in accordance with our Privacy Policy. To understand how your personal data will be processed, please view our Privacy Policy on our website https://www.oakshotels.com/en/privacy. By entering this Promotion, the entrant consents to the Promoter’s use, storage, and destruction of their information in accordance with that policy. Entrants agree that their personal details (including their full name and general residential location) may be displayed by the Promoter on their social media pages or website to announce the chosen winner of that competition for an indefinite period of time being at least 28 days to allow for legislative requirements.
11. Subject to legislative requirements, the Terms associated with this Promotion may be amended, varied or removed at the reasonable discretion of the Promoter without further notice.
12. Subject to legislative requirements, the Promotion may be withdrawn at any time prior to the Draw.
13. The Promotion and these Terms are governed by the laws of the State of Queensland. The Promoter and all entrants submit to the exclusive jurisdiction of the courts of the State of Queensland.
14. This Promotion is not sponsored, administered or associated with Atlas Events or the Brisbane Marathon Festival, Cairns Marathon Festival or Sunshine Coast Marathon Festival.
15. Images on any marketing collateral in relation to this Promotion are for illustrative purposes only.
16. Nothing in these Terms excludes, restricts, or modifies any rights or remedies which cannot be excluded under Australian Consumer Law.

HOW TO ENTER

1. To enter and be eligible to win, eligible entrants must, during the Promotion Period:
   1. Complete the Promotion entry requirements by following the prompts on the Promotion landing page at https://www.oakshotels.com/en/partnership/Run-Hard-Rest-Easy-Competition;
   2. Only submit one entry per person; and
   3. Opt in to receive email promotions from the Promoter and its related bodies corporate (if applicable).

DRAW

1. This Promotion is a game of chance. Skill plays no part in determining the winner. Accordingly, each eligible/valid entry has an equal chance of being selected.
2. The prize draw will be drawn by the Promoter at Level 26, 266 George Street, Brisbane, QLD 4000 (Draw Location) at 12:00 AEST on 4 August 2026 from all eligible/valid entries received during the Promotion Period to select one winner (Draw).
3. The winner of the Draw will be notified within 24 hours via email and telephone.
4. If the first eligible/valid chosen entry winner cannot be contacted or fails to respond to any attempted contact within 48 hours of the Draw, that entrant will be disqualified, their entry will be declared null and void and a second chance Draw for the unclaimed prize will take place at the Draw Location by the Promoter at 12:00 AEST on 6 August 2026. This process will be repeated until a valid entry winner is successfully contacted.
5. The winner of the Draw will be published on the @Oaks_Hotels profile on Instagram and Oaks Hotels Facebook page, within 5 days of the Draw.

PRIZES

1. The eligible/valid winner of the Draw will win a AU$1,000.00 accommodation voucher to be used at Oaks Hotels, Resorts, & Suites.
2. The accommodation voucher is subject to the following terms and conditions:
   1. The accommodation voucher is valid for up to three (3) years from date of issue and will not be extended under any circumstances.
   2. The accommodation voucher is only valid for use on accommodation at Oaks, Hotels, Resorts & Suites properties within Australia. To view available locations, see: https://www.oakshotels.com/en.

   4. Bookings are subject to availability at time of booking, and the accommodation voucher cannot be used in conjunction with any other promotions, discounts, or packages.

   7. If a confirmed booking requires amendment, it will be subject to our Booking Terms and Conditions and charges may apply.
   8. The accommodation voucher covers accommodation only, the eligible/valid winner is still responsible for all taxes and service charges payable.
   9. The accommodation voucher must be redeemed in a single booking and cannot be split across multiple stays or bookings.
   10. Any remaining credit not used on the accommodation voucher will be forfeited.
   11. The Promoter/Oaks Hotels, Resorts & Suites and any of its related entities are not responsible for lost, stolen, damaged, or unauthorised use of the accommodation voucher and reserve the right to refuse redemption or cancel a booking made using the accommodation voucher where there has been a breach of these terms or suspected unauthorised use. Please note a replacement accommodation voucher will not be issued in any circumstances.
3. Prizes cannot be transferred, exchanged or redeemed for cash or transferred or sold to any other person (other than the winner) and cannot be on-sold, exchanged for other goods or services, or for any other purpose.
4. The Promoter/Oaks Hotels, Resorts & Suites and any of its related entities are not responsible, directly or indirectly, for:
   1. any delays, reschedules, insolvency, acts of war, and force majeure impacting on the eligible/valid winner’s travel arrangements or use of Prizes by any third party product, good, or service provider;
   2. loss, damage, accidents, or injury arising from any aspect of any booking, reservation, or use of products, goods, or services connected with the Prizes; and/or
   3. any ancillary costs incurred by the eligible/valid winner including but not limited to travel arrangements and associated costs (as defined in clause 27), insurance, food and beverage costs, or any other costs, expenses, or fees incurred during use of the Prizes.
5. The eligible/valid winner is responsible for any and all other travel arrangements and associated costs (including but not limited to travel, flights, parking, food, transport, passports, visas, permits, local taxes, duties, travel insurance or any additional costs or charges including any damages incurred throughout your stays at Oaks Hotels, Resorts & Suites and/ or partner brand properties).
