Terms and Conditions of Entry for Oaks Hotels, Resorts & Suites “The Happiest Person” Social Media Competition* (Promotion)

Please read the terms and conditions carefully. By entering this promotion, you have confirmed you have read, understood and agree to abide by the terms and conditions.

1. These terms and condition of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.

2. The Promoter is Oaks Hotels & Resorts Limited (ACN 113 972 366)  (referred to as “Oaks Hotels, Resorts & Suites”) of Level 2, 26 Duporth Avenue, Maroochydore, Queensland 4558 (Promoter).

3. The Promotion will be open from 12:00pm (AEST) on 7 October 2022 until 11:59pm (AEST) on 22 January 2023 (Promotion Period).

4. Information on how to enter and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

5. If there is any inconsistency between these Terms and Conditions and anything else that refers to this Promotion, these Terms and Conditions will prevail.

6. Entry in the Promotion is only open to Australian residents:

(a) aged 18 years and over;

excluding:

(b) management, employees, directors and contractors of the Promoter, its related bodies corporate, the Participating and other agencies, firms or companies associated with the Promotion (including suppliers of prizes);

(c) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 6(b) of these Terms;

(d) persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and

(e) persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,(Eligible Entrant).

The persons referred to in paragraph 6(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.

7. Personal information used and/or collected for the purpose of this competition is in accordance with our Privacy Policy, which can be viewed on our website https://www.oakshotels.com/en/privacy. If you are the chosen as winner of the Promotion, you agree that personal details such as your name will be posted on the Oaks Hotels, Resorts & Suites @Oaks_Hotels profile on Instagram to announce that you are the chosen winner of the Promotion.

HOW TO ENTER

  1. To enter and be eligible to win, eligible entrants must, during the Promotion Period:
  1. Share photo or video on Instagram during the Promotional Period with a description of what makes them or their nominated person, couple or family ‘The Happiest Person’ or alternatively submit a text-only entry of 25 words or less by commenting on the ‘Competition Post’ posted by @oaks_hotels  on 20 December 2022, along with the hashtag #HappyFolksChooseOaks. 
  2. If the entry is via a photo/video it must also include a rationale of 25 words or less posted to their own Instagram account and use the single tag ‘@Oaks_Hotels’ in the photo/video and in the caption of the post. Participants will need to include their commentary in the caption/comment section with the hashtag #HappyFolksChooseOaks. This hashtag will be used to track public entries.
  3. If a user has a private account, they can alternatively DM us their entry, which will still be considered a qualified entry.
  4. Participants must follow @Oaks_Hotels profile on Instagram. 
  5. The Promotion is in no way sponsored, endorsed, administered by or associated with Instagram.
  6. Only one entry per person will be accepted.
  7. Entries with missing information including tags/hashtags will not be accepted and will be automatically disqualified at the discretion of the Promoter.
  8. Winner will be chosen by the Promoters Representative Dr Tim Sharp (Dr Happy) in collaboration with Promotor at 12:00pm AEST on 23 January 2023.
  9. Participants warrant those entries containing images of any other person, will be posted following obtaining express consent of the relevant person and will not include any content that contravenes any law, infringes the rights of any person or is obscene, defamatory, discriminatory, offensive or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing).

DRAW

9. The Promotion is a game of skill prize draw which will be conducted The Content Division, 36 Wyatt Street Newstead QLD 4006 on behalf of (Draw Location) by a chosen representative of the Promoter at 12:00pm AEST on 23 January 2023 from all Eligible Entries received during the Promotion (Draw) to select one winner. The winner will be notified within 48 hours via Instagram direct message and on-post comment.

10. If the first valid chosen entry winner cannot be contacted or fails to respond to any attempted contact within 1 days of the Draw, such winner will be disqualified, his/her entry will be declared null and void and a second chance Draw for the unclaimed prize will take place at the Draw Location by a chosen representative of the Promoter on 24 January 2023 at 12:00pm. This process will be repeated until a valid entry winner is successfully contacted.

11.The Draw winner will be notified by Instagram direct message and on-post comment within 48 hours of the Draw and published on the @Oaks_Hotels profile on Instagram  within 7 days of the Draw.

12.The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the Promotion result or any other decisions the Promoter makes in connection with the Promotion.

13. Prizes cannot be transferred, exchanged or redeemed for cash.

14. All entrants agree that if they win the prize, they will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the Internet. Photographs will be allowed only at the discretion of the Promoter.

PRIZE

15. The eligible entrant with a valid entry drawn will win 4 x 3 night stays at an Oaks branded property of their choice within Australia and New Zealand (Properties under Oaks Hotels, Resorts & Suites portfolio carrying the ‘AVANI brand’ will be excluded from this Prize) in a 1 or 2 Bedroom Apartment for up to 5PAX (subject to availability and blackout periods apply). Each holiday must be claimed within the following dates and is subject to the standard terms and conditions of stay which can be found on our website https://www.oakshotels.com/en/terms-and-conditions:

  • Holiday 1: 1 April 2023 - 30 June 2023
  • Holiday 2: 1 July 2023 – 30 September 2023
  • Holiday 3: 1 October 2023 – 31 December 2023
  • Holiday 4: 1 January 2023 – 31 March 2024

16. Oaks Hotels, Resorts & Suites is not responsible for any ancillary costs incurred by the winner including but not limited to travel costs, food and beverage costs or any other expenses incurred during these stays.

17. If the winner does not redeem their prize during the above-mentioned time periods in point 15, they will forfeit that holiday.

18. All bookings are subject to their respective availability and Blackout dates may apply which can be notified to you via phone by calling Oaks Hotels, Resorts & Suites on +61 7 2100 0577. In the event of amendment of a confirmed booking, Oaks Hotels standard conditions, penalties and charges may apply at the discretion of Oaks Hotels. In the event of cancellation, the stay will be deemed forfeited and non-refundable.

19. The winner agrees to become the consumer face of  ‘Happy Folks Choose Oaks’ marketing campaign (single or extended execution) which will include one photoshoot with the winner during their first stay and subsequent 1x stay as agreed.

20.The Prize cannot be redeemed with any other offer, has no cash equivalent either expressed or implied, and under no circumstances can be on-sold for profit or any other purpose.

21.Promoter and any of its related entities is not responsible (either directly or indirectly) for delays, reschedules, insolvency, acts of war and force majeure impacting on the winner’s travel arrangements or use of the Prize by any third party product or service provider; loss, damage, accidents or injury arising from any aspect of any booking, reservation or use of products or services connected with the Prize.

22.The redeemer of the Prize is responsible for any and all other travel arrangements and associated costs (including but not limited to travel, flights, parking, food, transport, passports, visas, permits, local taxes, duties, travel insurance or any additional costs or charges including any damages incurred throughout your stays at Oaks properties).

23. The terms and conditions associated with this Promotion may be amended, varied or removed at the reasonable discretion of Oaks Hotels, Resorts & Suites without further notice.
