Terms and Conditions of Entry for Oaks Hotels, Resorts & Suites “Port Douglas Christmas Wish List” Oaks Competition* (“Promotion”)

Please read the terms and conditions carefully. By entering this Promotion, you confirm you have read, understood and agree to abide by the terms and conditions.

 

1. These terms and conditions of entry, including information on how to participate and the prize details (“Terms”), apply to the Promotion.

2. The promoter is Oaks Hotels & Resorts Limited (ACN 113 972 366) of Level 2, 26 Duporth Avenue, Maroochydore, Queensland 4558 (“Promoter”).

3. The Promotion will be open from 7:00am (AEST) on 1 November 2023 until 11:59pm (AEST) on 15 December 2023 (“Promotion Period”).

4. If there is any inconsistency between these Terms and anything else that refers to this Promotion, these Terms will prevail.

5. Entry in the Promotion is only open to local residents (children aged 0 to 16) of Port Douglas and Mossman, Queensland, (a child’s parent must enter on the child’s behalf), excluding:

  a. management, employees, directors and contractors of the Promoter, its related bodies corporate, agencies, firms or companies associated with the Promotion;
        b. a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms;
        c. persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
        d. persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,

  (“Eligible Entrant”). 

The persons referred to in paragraph 5(b) of these Terms include natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.

 

HOW TO ENTER

6. To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:

  a. dine at Oak & Vine Port Douglas (“Oaks Venue”) between 1 November 2023 and 15 December 2023 (inclusive);
        b. complete the ‘letter to Santa’ entry form (“Entry Form”) provided by the Oaks Venue ensuring accurate details are provided; and
        c. deposit the Entry Form into the mailbox at the Oaks Venue.

  (“Valid Entry”)

7. Only one Valid Entry per Eligible Entrant per day within the Promotion Period will be accepted.

 

PRIZE

8. Subject to the qualifications and exclusions in clauses 9 to 11 inclusive, the prize for this Promotion is: item number 1 written on the Entry Form (retail value of no more than $500) (“Prize”).

9. The Prize cannot have a retail value of more than $500.

10. The Prize must be able to be sourced by the Promoter.

11. The Prize cannot be:

  a. a prohibited prize as prescribed by the Charitable and Non-Profit Gaming Regulation 1999 (Qld);
        b. an animal or animals; or
        c. accommodation or food and beverage for any venue except at the Oaks Venue.

12. The Promoter reserves the right, in its sole discretion, to substitute the Prize with another prize:

   a. of a similar nature to any of the items listed on the Entry Form; and/or
        b. of similar or greater value.

 

DRAW

13. The Prize draw will be drawn by the Promoter at the Oaks Venue on 16 December 2023 from all Valid Entries received (“Draw”) to select one winner (“Winner”).

14. The Winner will be notified within 24 hours of the Draw via phone using the details supplied on the Entry Form.

15. If the Winner cannot be contacted or fails to respond to any attempted contact within 24 hours of the Draw, such Winner will be disqualified, their entry will be declared null and void and a new Winner will be re-drawn from the remaining Valid Entries. This process will be repeated until a Winner is successfully contacted.

 

GENERAL

16. The Promoter and any of its related entities is not responsible (either directly or indirectly) for:

   a. the appropriateness of the Prize;
        b. loss, damage, accidents or injury arising from any aspect of any use of the Prize; or
        c. delays in receiving the Prize.

17. The Winner is responsible for any and all other incidental costs, accessories, subscriptions or the like associated with the Prize.

18. The Prize cannot be transferred, exchanged or redeemed for cash. 

19. This Promotion may be withdrawn by the Promoter at any time prior to the Draw.  

20. Personal information used and/or collected for the purpose of this Promotion is in accordance with our Privacy Policy, which can be viewed on our website  https://www.oakshotels.com/en/privacy

21. The Winner (parent) may be requested by the Promoter to have their photo taken receiving the prize for the purposes of the Promoter displaying the photo on its social media platforms, website and/or in local newspaper. 

22. The Promoter will not enter into correspondence regarding the Promotion result or any other decisions the Promoter makes in connection with the Promotion.

23. All Entry Forms become the property of the Promoter and will not be returned.
